Account registration and storage

When you register with the Sternberg Press website, you will need to choose a contact email address and password (initial password is automatically generated and sent via email to you). You are responsible for all sessions and transactions taken under these details. You should keep your password safe and not disclose it to anyone. You should change it immediately if you feel it has been compromised.

You may choose to store your billing and shipping addresses with our card payment provider, Stripe. You likewise have the option to store these shipping and billing details with our site directly within the account you have registered. Providing Sternberg Press with an up-to-date billing and shipping address when placing an order is your responsibility.

The contracting parties

Any contract for purchases made through the Sternberg Press website will be with: Sternberg Press Ltd., 71–75 Shelton Street, London WC2H 9JQ, UK.

Your order

Sternberg Press must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed. Once payment has been authorized Sternberg Press will confirm your order by sending an email to you at the email address you provide. The order confirmation email will include your name, the order number and the total price. Sternberg Press will make every effort to ensure that payment for your order is only taken once your goods are available for download or have shipped. Acceptance of the payment by Sternberg Press will bring into existence a legally binding contract between us on these terms.

Availability of goods

Sternberg Press will make every effort to ensure that books are in stock before taking payment. However, if Sternberg Press has insufficient stock to deliver the goods ordered by you the account user, then we will notify you as soon as possible and any sum debited by Sternberg Press from your card will be re-credited to your bank or Paypal account, Sternberg Press will notify you by email at the address given by you when you submitted your order. The refund will be made as soon as possible and in any event within 30 days of your order. Sternberg Press will not be obliged to offer any additional compensation for disappointment suffered.

Shipping costs

Any applicable shipping costs will be displayed during checkout, before you approve payment. Sternberg Press offers its shipping service along with the option for tracking numbers and insurance to be provided in addition to the normal tariff costs. Shipping costs are calculated via a matrix comprised of service provider, type of service selected (w/ tracking number, w/o tracking number, etc.), weight and volume, and destination zone (tariff zone A, B, C, D, etc.).

Delivery of goods to you

Sternberg Press will post the goods ordered by you to the name and address you give Sternberg Press at the time you make your order. Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of dispatch of the order. All delivery times quoted on the website are estimates only, based on availability, normal processing and delivery companies. You will become the owner of the goods you have ordered when the goods are dispatched to you from our distribution center.

Sales Tax

Europe: Any applicable taxes will be displayed during checkout, before you approve payment. All Euro prices displayed on the Sternberg Press website are inclusive of VAT. If you are outside the Netherlands, your final price may be different depending upon the VAT rate that applies to your location, in which case this will be displayed before you submit your final order. Under EU VAT legislation certain book items (such as audiobooks and ebooks) are not eligible for reduced-rate VAT and in those cases the standard VAT rate will apply. 

Rest of World: Goods sold by Sternberg Press that are dispatched to addresses in the rest of the world are not subject to EU VAT, but may be subject to import duties, taxes, and charges that are levied once the package reaches your country. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from Sternberg Press, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods.

Liability and returns

If the goods shipped by Sternberg Press are not what you ordered or are damaged or defective or if the delivery is of an incorrect quantity, Sternberg Press shall have no liability to you unless you notify Sternberg Press in writing to our contact address with a description of the problem within 14 days of the delivery of goods in question. If you do not receive goods that you have ordered within 30 days of the date on which they were dispatched to you, Sternberg Press shall have no liability to you unless you notify Sternberg Press in writing at the Sternberg Press contact address of the problem within 60 days of the date on which the goods were dispatched out to you. Sternberg Press shall carry no liability for losses or damages arising from the transit of the goods, the delivery service, or as a result of an incorrect delivery address provided by the customer.

If you notify a problem to Sternberg Press under this condition, Sternberg Press’s only obligation will be, at our own discretion, to make good on any shortage or non-delivery; to replace any goods that are damaged or defective; or to refund to you the amount paid by you for the goods in question to the original method of payment.

Prior to any monetary refund or exchange of damaged or defective goods to be issued, goods must first be returned, at customers expense, along with original invoice/ order confirmation to: Hexspoor E-fulfilment, Attn: Afdeling retouren, Van Salmstraat 54, 5281 RS Boxtel, The Netherlands.

Sternberg Press will not be liable to you for any indirect or consequential loss or damage arising out of any problem you notify to Sternberg Press under this condition and Sternberg Press shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under the paragraph above.

Nothing in this condition is, however, intended to limit any rights you might have as a consumer under applicable local law that may not be excluded nor in any way to exclude or limit Sternberg Press liability to you for any death or personal injury resulting from its negligence.

Nothing in this contract creates any right which is enforceable by any person who is not a party to the contract.

Force Majeure

Sternberg Press shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

Invalidity

If any part of these conditions is unenforceable (including any provision in which Sternberg Press excludes its liability to you) the enforceability of any other part of these conditions will not be affected.

Entire Agreement

These terms and conditions, together with the current Sternberg Press website prices, delivery details and Sternberg Press contact details, set out the whole of our agreement relating to the supply of the goods to you by Sternberg Press. These terms and conditions cannot be varied except in writing signed by a director of Sternberg Press. In particular nothing said by any sales person on behalf of Sternberg Press should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by Sternberg Press. Sternberg Press shall have no liability for any such representation being untrue or misleading.

Governing law / Place of jurisdiction

These terms and conditions are subject to the law of England and Wales.
